These Terms of Service (“Terms”) govern your access to and use of shoptopos.com (the “Site”) and any purchases, services, events, communications, or other interactions offered by TOPOS (“TOPOS,” “we,” “us,” or “our”). 

Throughout these Terms, “you” and “your” refer to the person accessing the Site, placing an order, or otherwise using our services. 

By visiting the Site, placing an order, creating an account, subscribing to communications, or otherwise interacting with TOPOS, you agree to these Terms and our related policies, including our:

TOPOS is a home and lifestyle retailer offering thoughtfully gathered goods from independent makers, artists, brands, and suppliers.

2. Eligibility 

You must be at least 18 years old or the age of majority in your state of residence to make a purchase through the Site. 

Individuals under the age of majority may use the Site only with the involvement and permission of a parent or legal guardian. 

By using the Site, you represent that you meet these eligibility requirements and are legally able to enter into a binding agreement. 

3. Changes to These Terms 

We may revise these Terms periodically to reflect changes to our products, services, business practices, technology, or legal obligations. 

The current version will be posted on this page with an updated “Last updated” date. Changes become effective when posted unless otherwise stated. 

Your continued use of the Site after revised Terms are posted constitutes acceptance of the updated Terms. 

4. Online Store Platform 

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services. 

Your use of certain payment methods, checkout features, or Shopify services may also be subject to terms and policies established by Shopify or the applicable third-party provider. 

5. Products and Availability 

We thoughtfully source many products in small or limited quantities. Product availability is not guaranteed, even when a product appears available on the Site. 

We reserve the right to:

We may limit quantities when we reasonably believe an order is intended for unauthorized resale, commercial redistribution, fraudulent activity, or misuse of a promotion.

We make reasonable efforts to display product descriptions, measurements, materials, colors, images, prices, and other information as accurately as possible.

7. Handmade and Natural Variations 

Many TOPOS products are handcrafted, small-batch, vintage-inspired, or made from natural materials. 

Variations in the following characteristics may occur:

Products may also develop patina, wear, fading, or other changes over time depending on handling, environment, exposure, and care. 

8. Pricing 

All prices are displayed in U.S. dollars unless otherwise stated. 

Prices may change at any time without notice. A price change will not affect an order that we have already accepted, except where the displayed price resulted from an obvious error. 

Prices displayed on the Site generally do not include:

We are not obligated to honor a price that is clearly incorrect because of a typographical, technical, system, vendor, or data-entry error. If an error affects your order, we may contact you for instructions or cancel the affected item and issue an appropriate refund. 

9. Taxes 

Applicable sales taxes are calculated and collected during checkout based on the order, delivery destination, and applicable law. 

You are responsible for any taxes, duties, fees, or charges associated with your order that are not collected by us at checkout. 

10. Orders and Order Acceptance 

Submitting an order constitutes an offer to purchase the selected products under these Terms. 

An automated order-confirmation email acknowledges that we received your order. It does not necessarily mean that we have accepted or fulfilled the order. 

We may review an order before accepting it. We reserve the right to refuse, limit, place on hold, or cancel an order for reasons including: 

If we cancel an order after payment has been collected, we will issue a refund for the canceled amount to the original payment method, as appropriate. 

11. Customer Information 

You agree to provide current, complete, and accurate information when placing an order or using the Site.

Please contact us immediately if you discover an error. We will make reasonable efforts to correct information before an order ships, but we cannot guarantee changes after an order has entered processing. 

TOPOS is not responsible for delays, failed deliveries, returned packages, or additional expenses caused by incomplete or inaccurate information provided by the customer. 

12. Payment 

You agree to provide valid payment information and represent that you are authorized to use the payment method submitted. 

By placing an order, you authorize TOPOS and its payment providers to charge the total amount displayed at checkout, including the product price, taxes, shipping charges, and any other disclosed fees. 

Payment methods may be authorized or charged at the time the order is submitted. 

We may request additional information or verification before accepting or fulfilling an order. If payment cannot be authorized or verified, the order may be delayed or canceled. 

13. Shipping and Delivery 

Orders are shipped according to our Shipping & Delivery Policy, which is incorporated into these Terms. 

Processing and delivery dates are estimates unless we expressly state otherwise. Delivery may be affected by weather, carrier delays, holidays, service interruptions, product availability, or circumstances outside our reasonable control. 

You are responsible for providing a complete and secure delivery address and for monitoring the tracking information provided. 

Once an order has been transferred to the shipping carrier, delivery is subject to the carrier’s operations and policies. 

Additional information regarding processing times, shipping charges, delayed packages, address errors, damaged shipments, and delivery issues is provided in our Shipping & Delivery Policy. 

14. Shipping Delays 

We make reasonable efforts to ship orders within the timeframe stated on the Site or in the applicable product description. 

If we are unable to ship within the stated timeframe, we may contact you with an updated estimate and any options required by applicable law. 

If no shipping timeframe is provided, we will process and ship orders within a reasonable period consistent with applicable requirements. 

Preorders, backorders, personalized products, made-to-order products, and products with stated lead times are subject to the estimated schedule displayed on the applicable product page. 

15. Preorders and Backorders 

Products offered for preorder or identified as backordered may not be immediately available. 

Estimated availability and shipping dates are provided in good faith but are not guaranteed. Production, maker, vendor, freight, or carrier delays may affect the estimated timeline. 

Unless otherwise stated, an order containing both available and preorder or backordered items may be held until all items are available to ship. 

If a significant delay occurs, we may contact you with updated information and any available options. 

16. Returns, Exchanges, and Refunds 

Returns, exchanges, and refunds are governed by our Returns & Exchanges Policy, which is incorporated into these Terms. 

Eligible returns must be requested within 14 days of the date the order was delivered and must satisfy all return requirements. 

Returned products must generally be: 

Customers are responsible for return shipping costs unless the product arrived damaged, defective, or incorrect. 

Original shipping charges are generally nonrefundable. 

Refunds are issued to the original payment method after the returned item has been received, inspected, and approved. 

We reserve the right to decline a return or reduce a refund when an item has been used, worn, altered, damaged, or returned without its original packaging, accessories, or tags. 

17. Final-Sale Products 

The following products are final sale and cannot be returned or exchanged except when required by law or when the product arrives damaged, defective, or incorrect:

Please review product descriptions carefully before purchasing final-sale merchandise. 

18. Damaged, Defective, Missing, or Incorrect Products 

You must inspect your order promptly after delivery. 

If a product arrives damaged, defective, missing, or incorrect, contact us within three days of delivery at support@shoptopos.com. 

Your message should include: 

Please keep the product and all original packaging until we complete our review. 

Depending on the circumstances and product availability, we may offer a replacement, refund, repair, or another appropriate resolution. 

Damage caused after delivery by misuse, accidents, improper care, ordinary wear, environmental exposure, or failure to follow product instructions is not considered a product defect. 

19. Order Changes and Cancellations 

We begin processing orders as quickly as possible. 

Contact us immediately if you need to request a change or cancellation. We cannot guarantee that an order can be changed or canceled after it has been submitted. 

Once an order has entered processing or shipped, it may no longer be eligible for cancellation and will be subject to our Returns & Exchanges Policy. 

Cancellation requests for personalized, custom, made-to-order, preorder, backordered, seasonal, or final-sale products may be restricted once production, preparation, or fulfillment has begun. 

20. Gift Cards 

Gift cards are subject to our Gift Card Policy and any terms displayed at the time of purchase. 

Gift cards: 

The purchaser is responsible for providing an accurate recipient email address when sending a digital gift card. 

TOPOS is not responsible for gift cards delivered to an incorrect email address entered by the purchaser. 

21. Promotions and Discount Codes 

Promotions and discount codes are subject to the terms displayed with the applicable offer. 

Unless otherwise stated: 

We reserve the right to modify, suspend, cancel, or refuse a promotion when we reasonably believe it has been used fraudulently, improperly, or contrary to its stated terms. 

A promotion ending or changing does not entitle a customer to a retroactive discount or price adjustment. 

22. Giveaways and Contests 

Giveaways, contests, and similar promotions may be subject to separate official rules. 

By entering a giveaway or contest, you agree to the applicable rules and eligibility requirements. 

Unless otherwise stated: 

Social-media platforms used to promote a giveaway are not sponsors, administrators, or endorsers of the promotion unless expressly stated. 

23. Product Care and Safety 

You are responsible for reviewing and following all care, safety, warning, installation, storage, and use instructions provided with a product or included in its listing. 

Products should be used only for their intended purpose. 

Certain products may require special precautions, including: 

Keep candles, matches, small parts, fragile items, sharp objects, and potentially hazardous products away from children and pets. 

Discontinue use of any product that appears damaged or causes irritation or an unexpected reaction. 

Product information provided on the Site is for general informational purposes and is not medical, health, safety, or professional advice. 

24. Bath, Body, Skincare, and Fragrance Products 

Ingredient lists and product information for bath, body, skincare, and fragrance products may be supplied by the applicable maker or manufacturer. 

You are responsible for reviewing ingredients before use, particularly if you have allergies, sensitivities, medical conditions, or are pregnant or nursing. 

We recommend conducting a patch test when appropriate. 

Discontinue use if irritation or an adverse reaction occurs and consult an appropriate medical professional when necessary. 

TOPOS does not make medical claims regarding these products, and product information should not be interpreted as diagnosing, treating, curing, or preventing any disease or medical condition. 

25. Food and Consumable Products 

Review all labels, ingredients, allergen statements, preparation instructions, and expiration information before consuming a food, beverage, or consumable product. 

Products may be produced or packaged in facilities that also handle common allergens. 

TOPOS cannot guarantee that a product is free from allergens, cross-contact, or ingredients not identified by the manufacturer. 

Contact the applicable manufacturer or maker before purchase if you have specific dietary restrictions or allergy concerns. 

26. Customer Accounts 

If customer accounts are available, you are responsible for: 

We may suspend or terminate an account when we reasonably believe it has been compromised, used fraudulently, or operated in violation of these Terms. 

27. Reviews and User-Submitted Content 

The Site may allow you to submit reviews, comments, photographs, messages, testimonials, social-media content, or other materials (“User Content”). 

You retain ownership of your User Content. By submitting User Content to TOPOS, you grant us a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and promote that content in connection with our business, Site, products, marketing, advertising, and social-media channels. 

You represent that: 

We may remove or decline to publish User Content at our discretion, but we are not obligated to monitor all submissions. 

Do not submit sensitive personal information in a review or other content intended for public display. 

28. Intellectual Property 

The Site and its contents are owned by or licensed to TOPOS and are protected by applicable intellectual-property laws.

You may access and use the Site only for personal, noncommercial shopping and informational purposes. 

You may not copy, reproduce, distribute, modify, publish, sell, license, create derivative works from, scrape, download, or commercially exploit Site content without our prior written permission. 

Nothing in these Terms transfers ownership of any intellectual-property right to you. 

29. Prohibited Uses

30. Third-Party Tools, Services, and Links 

The Site may include tools, services, content, payment options, integrations, or links provided by third parties.

The inclusion of a link or integration does not necessarily constitute an endorsement by TOPOS. 

31. Website Availability 

We strive to keep the Site available and functioning properly, but we do not guarantee uninterrupted, timely, secure, or error-free access.

32. Errors and Corrections

If we cancel a paid order because of an error, we will refund the canceled amount to the original payment method.

To the fullest extent permitted by law, TOPOS and its owners, members, employees, contractors, affiliates, service providers, makers, and suppliers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to: 

To the fullest extent permitted by law, TOPOS’s total liability for a claim relating to a product or order will not exceed the amount you paid to TOPOS for the product or order giving rise to the claim. 

These limitations do not apply where prohibited by law or to liability that cannot legally be limited or excluded. 

35. Indemnification 

To the fullest extent permitted by law, you agree to indemnify and hold harmless TOPOS and its owners, members, employees, contractors, affiliates, service providers, makers, and suppliers from claims, liabilities, losses, damages, costs, and reasonable legal fees arising from:

36. Force Majeure 

TOPOS is not responsible for delays or failure to perform caused by circumstances outside our reasonable control, including:

Marketing emails and text messages are subject to your consent and applicable opt-out rights.

Nothing in this section deprives you of any consumer protection that cannot lawfully be waived. 

41. Dispute Resolution and Venue 

Before filing a formal legal claim, you agree to contact us at support@shoptopos.com and make a good-faith effort to resolve the dispute informally. 

Unless applicable law requires otherwise, any legal action arising from or relating to these Terms, the Site, the Services, or a TOPOS purchase must be brought in a state or federal court with appropriate jurisdiction in Salt Lake County, Utah. 

You and TOPOS consent to the personal jurisdiction of those courts. 

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or seeking emergency or injunctive relief where appropriate.
